iii.Vicarious Admissions [801(d)(2)(C)–(E)]

Admissions may also take the form of vicarious statements. These are statements which the party does not actually make but, instead, are made for him or her. In cases such as these, the statement will be considered as though it was made by the party whom it is offered against. Rules 801(d)(2)(C)–(E) cover these vicarious admissions made under the following circumstances: the statement was made by a person whom the party authorized to make a statement on the subject [801(d)(2)(C)]; the statement was made by the party’s agent or employee [801(d)(2)(D)]; or the 149

statement was made by a co-conspirator [801(d)(2)(E)]. We will look at a few different relationships to help understand this rule.
